"Website" is defined as the domain names
www.buses-online.co.uk
(and previously
www.motion-images.com),
owned and operated by John Godwin & Phoenix Web Hosting Services, including all images, photographs and text contained therein. All
users of this Website are deemed to have read, understood and
accepted all of the Terms & Conditions of Use displayed on this
page, without exception.
1. General Statement
This Website is not an official site of any of the companies whose
vehicles are shown. All enquiries relating to this website should be
communicated via
email. Should any individual or organisation have any
objection to content being displayed within this Website, then this
should be communicated in the first instance via email
where it will receive our prompt
attention.
2. Copyright
All images displayed on the Website remain the property and
copyright of John Godwin, unless specifically otherwise stated. No
images from this Website may be reproduced, copied, downloaded, stored or further
distributed in any form whatsoever without the specific prior
written permission of the copyright holder. Images on this site have
been digitally watermarked, and in many cases the images shown are
cropped, rotated and enhanced versions of larger original images. Copyscape is also in use.
This site and its contents are protected
by UK Copyright Law and, as appropriate, the DMCA (Digital
Millennium Copyright Act). Legal action will be considered and taken
against those who reach our copyright. Regardless of the geographic
location or viewing location of visitors to this Website, all
visitors agree that the jurisdiction of the Courts of England and
Wales shall apply to their use. Unauthorised use of any photographic
content from this site implies acceptance by the third party to pay
a £100 administration fee, plus £50 for each and every image used.
3.
Subscriptions
The Website Albums are only accessible to those individuals who have
chosen to purchase a subscription to this Website (more
information). Subscriptions are only available using the on-line
option shown on this Website, and when completed the user will be
provided with a unique username and password, which will remain
valid a period of 12 months. All
access to the Website Albums is logged, including the IP address of
the user, and any evidence of unauthorised disclosure of account
information will result in the cancellation of that individual's
access to the Website Albums, without prior notice, and without refund of any remaining
subscription. Please note that we reserve the right to refuse to
grant access following an application, without having to provide a reason, and no
correspondence will be entered into. In such cases, a full refund of
any payment will be made.
4. Basis of Subscription
Whilst each subscription is acknowledged with access to the Website
Albums for a period of 12 months, this
does not confirm or imply that the Website albums will continue to
operate for the duration of that period. Similarly, we will not be
held liable for any unavailability issues which may affect the
normal operation of this Website, and no refunds or extensions will
be provided. The subscriptions received are
used to offset the running costs of operating and improving this
Website. There is no contract or obligations implied or granted by
or to users of the Website galleries.
5. Help - My Account No
Longer Works
Please take a moment to check the original information you were
provided with when you subscribed to Motion Images: it is most
likely that you have passed your expiry date. If this is the case,
we would love your support for another year and would be grateful if
you would consider subscribing for a further year. Thank you!
6. Paypal
Persons purchasing a subscription to this Website will be making a
payment by Paypal. It is not a requirement to have an existing Paypal account
to use this facility, and one-off payments are acceptable. This
service is a secure payment service (check that the Paypal webpage
commences "https"), and at no time do the Website owners have access
to any of the payment details submitted during the process.
Once a
payment has been successfully completed, the user's account details
will be displayed on a secure screen. Please make a written note of
these details, which should be kept confidentially, as they will not be available for viewing once the
window has been closed.
7. Privacy Policy & Data Protection Act
Phoenix Web Hosting Services, who own and operate this Website, is registered under the Data Protection
Act (registration number Z1074036). All personal data acquired and
processed in the course of providing this Website is in accordance
with our above referenced registration.
8. Photograph Quality
Images displayed within this website are of two distinct
types. The vast majority are recent photographs which have been taken on a Kodak 8.1MP
camera, and the images are then compressed, formatted and edited to fit the
standard for this Website. Many of the older images prior to 2000 are
manual scans taken from the original 35mm negatives or slides, and these
have reproduced
into JPEG format with varying degrees of quality. We have taken the
decision to upload a number of scanned images that are clearly of a lesser
quality than the digital photographs, in the interests of variety and
creating historical records: we hope to revisit and replace these
scanned images with higher resolution versions as time allows in the
future.
This site is prepared for viewing at an optimal resolution of 1024 x
768, using Internet Explorer 8.0 or earlier. It has also been prepared
for viewing using Mozilla Firefox. Viewing at other resolutions, or
using other browsers, may affect the way in which pages on this site
are displayed. The latest browser versions fully compatibility
tested are Internet Explorer 8.0.6001 and Mozilla Firefox 3.0.17.
9.
Guest/Submitted Photographs
Guest photographs have been
submitted by official sources and individuals from around the world, and
will be displayed in a manner which clearly identifies the submitter and
the
copyright holder. We only accept guest photographs by prior arrangement:
non-solicited work will not be accepted, and will be deleted without
prior notice. The act of
submitting photographic content to Buses Online confirms that the
submitter:
a) owns the
copyright to the photographs, and retains the full rights to publish them
without restriction
b) agrees to
grant Buses Online a royalty-free, non-exclusive licence to
publish the submitted content in any way that we see fit
c) agrees that
Buses Online has the sole right to select which images, if any,
to include, and that this decision is final: no correspondence will be
entered into
d) agrees to
fully indemnify John Godwin, Buses Online (Motion Images) and Phoenix Web
Hosting Services from any and all claims arising from the use of the
submitted content
e) agrees that
the photographs will be suitably annotated by Buses Online to include both the site name,
and the name of the submitter
f) has not
submitted the same images to any other similar website - Buses Online will not
publish photographs that have previously been posted elsewhere
In the event
that a submitter does not accept any of the seven conditions above, then they
should not submit content to Buses Online. Should
an individual have any issue or objection to any guest photograph found
within Buses Online,
please contact us immediately.
10. Links
There are numerous links from this
Website to other websites on related subjects. Such links are
provided in good faith, and we cannot accept any responsibility for
the continuing suitability of content which may be found by using
such links. Should you discover any questionable or unacceptable
content whilst following a link from this Website, please contact us

and action taken as necessary. There may be information and/or links
to operators, traders or suppliers: this Website acts only as an
advertising medium for such providers, and will not in any way be
party to any transaction that may result. We do not endorse the
products or services of any operators, traders or suppliers:
potential purchases are advised to seek independent professional
advice if required.
11. Buses Online or Motion Images?
This website operated for the first year or so under its
original name of Motion Images - a name originally created to
provide a wide range of transport related photographic content.
However, it soon became clear that the bus and coach photograph site
was growing rapidly and attracting increasing interest to the point
where it was felt that it required its own clear identity - hence "Buses
Online". The copyright text on the first 15,000 photos or so will
remain "Motion Images": all new content from 2009 onwards
will be "Buses Online".
12. How Many
Photographs?
Q. Exactly how many photographs are there on Buses Online?
A. We don't know. Somewhere north of 25,000.
